Welcome to Daily Disco! These Terms and Conditions ("T&Cs") govern your access and use of our subscription service ("Service") available at dailydisco.app. By subscribing to or using the Service, you agree to be bound by these T&Cs.
2. Services Offered
DailyDisco provides a subscription-based service that helps you find new music on Spotify.
3. Subscription Fees and Billing
Pricing: The Service is offered with a yearly subscription for $4.99 USD.
Free Trial: We offer a 10-day free trial period during which you will not be charged. However, if you delete your account before the trial period ends, you will lose access to the trial. If you decide to subscribe after the trial or at any point afterward, the standard cost is $4.99 per year.
Billing: After the free trial ends, you will be automatically billed $4.99 USD each year to continue using the Service. Your subscription will automatically renew on a yearly basis at the then-current rate until you cancel.
Payment Processing: We accept payments through secure methods including: Visa, Mastercard, Discover Amex, Apple Pay, and Google Pay.
Refunds: We offer a full refund within 10 days of your initial purchase if you cancel your subscription before the end of the free trial period. We do not offer refunds for partial months of service. California Civil Code Section 1771(a)(1) also allows you to cancel your subscription and obtain a prorated refund of any unused portion of the subscription fee, even after the free trial period ends.
4. Term and Termination
Term: Your subscription continues on a year-to-year basis.
Auto-Renewal: Unless you cancel your subscription before the end of the current billing period, it will automatically renew for another year at the then-current rate.
Cancellation: You can cancel your subscription at any time by visiting your account settings on our website or contacting our customer support team matt@dailydisco.app.
Termination by Us: We may terminate your subscription for cause, such as violation of these T&Cs or non-payment.
5. Intellectual Property
The Service and all its content, including but not limited to text, graphics, logos, images, and software, are the property of Daily Disco or its licensors and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use only. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Service.
6. Disclaimers and Limitations of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE. YOU AGREE TO USE THE SERVICE AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

8. Governing Law and Dispute Resolution
These T&Cs shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these T&Cs shall be resolved by informal negotiations, then arbitration.
9. Entire Agreement and Severability
These T&Cs constitute the entire agreement between you and us regarding your use of the Service. If any provision of these T&Cs is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

We may update these T&Cs from time to time. We will notify you of any changes by posting the new T&Cs on our website. You are advised to review these T&Cs periodically for any changes. Your continued use of the Service after the posting of revised T&Cs constitutes your acceptance of the revised T&Cs.
